Record the date and type of the court decision.
Step by step: This is how you proceed
- Read the final decision carefully and save it.
- Check the status in the public bankruptcy file.
- Determine what information KSV and CRIF are still processing.
- If necessary, make factual requests for information or corrections.
What documents do you need?
Decision on the debt discharge procedure (Abschöpfungsverfahren), court case number, information. Only send sensitive documents via a secure, official channel and only when actually necessary.
When should I act?
The inspection rule depends in particular on the requirements in Section 256 IO.
This limit is important
The conclusion of a debt discharge (Abschöpfungsverfahren) procedure is not a general deletion promise to all private companies.
Free help outside DATENCHECK
State-recognised debt advice services in Austria provide free support. For payment plans, debt discharge proceedings and court questions, they are more appropriate than a private form-preparation service.
Check the official body and eligibility ↗Check the applicable remit and eligibility criteria. A GDPR request does not automatically suspend court or other important deadlines.
What can I do myself for free?
The statutory information and other rights of those affected can generally be exercised without DATA CHECK. The Austrian data protection authority offers samples that can be used free of charge. Private technical form preparation is only a voluntary additional service, not a prerequisite for exercising your rights.
According to the recommendation of the Austrian data protection authority, you should first request information and, if necessary, only then separately request correction or deletion. In principle, a request for information must be responded to within one month; a legally permissible extension is possible.
Frequent question
Are all creditworthiness data gone after a residual debt has been discharged?
Not necessarily. Public and private data storage must each be checked separately.
