Save the rejection and the name of the mobile operator.
Step by step: This is how you proceed
- Request information about stored personal information from the provider.
- Ask about the origin, categories and, if applicable, recipients of the data.
- If necessary, check KSV/CRIF separately if it is actually involved.
- Request correction of demonstrably inaccurate information later.
What documents do you need?
Application, rejection date, contract history and existing information. Only send sensitive documents via a secure, official channel and only when actually necessary.
When should I act?
Immediately after the rejection, it makes sense to document the application and information.
This limit is important
A GDPR request does not force a mobile phone contract and does not guarantee a change in decision.
Free help outside DATENCHECK
For eligible disputes about communications services, RTR mediation may be available after a written complaint to the provider. It does not automatically cover every refusal of a new contract.
Check the official body and eligibility ↗Check the applicable remit and eligibility criteria. A GDPR request does not automatically suspend court or other important deadlines.
What can I do myself for free?
The statutory information and other rights of those affected can generally be exercised without DATA CHECK. The Austrian data protection authority offers samples that can be used free of charge. Private technical form preparation is only a voluntary additional service, not a prerequisite for exercising your rights.
According to the recommendation of the Austrian data protection authority, you should first request information and, if necessary, only then separately request correction or deletion. In principle, a request for information must be responded to within one month; a legally permissible extension is possible.
Frequent question
Can a cell phone contract be refused because of credit information?
Data sources can play a role in an audit. Whether this happened in this specific case remains to be determined.
